CLINTON, N.C.  – A man armed with a shotgun was shot and killed by police while he was in a pickup truck in a Burger King parking lot Sunday morning, according to Clinton Police and video of the incident.

According to authorities, officers responded to the Burger King located 100 Southeast Blvd. for an unknown call for help at approximately 11:57 p.m. Saturday. When officers arrived, they found a man in a truck armed with a shotgun in the parking lot.

Responding officers, including a North Carolina State Highway Patrol trooper, closed off the parking lot and tried to negotiate with the man to surrender, police said. The man did not respond to the officer’s commands to put the weapon down.

Authorities said that the man pointed his shotgun at the officers and was then shot and killed. The shooting occurred just before 12:20 a.m. The man was pronounced dead at the scene.

Witnesses Juana Benick and her nephew captured cell phone video of the shooting.

Nearly 20 minutes after the man was discovered in the truck by police — as seen in video — the man opens the truck’s door and then dozens shots are heard.

In the 59-second video, several officers can be seen from at least three different angles firing at the pickup truck.  At one point, shots stop and then several more shots are fired by officers.

After the shooting stops, the pickup truck’s horn can be heard blaring in the background. Then, a few more shots are fired by officers.

“As far as I know the guy was just sitting in the truck, the next thing we knew he opened the door of his truck and that’s when they started shooting him. I don’t know if he pointed something at them or not, I couldn’t see that,” said Juana Benick, a witness.

Police have not identified the man. No officers were injured during the incident.

The Clinton Police Department has requested the State Bureau of Investigation to conduct an investigation in the details of the shooting.  The Department’s Internal Affair Unit will also conduct an administrative investigation into the shooting.

All officers involved have been placed on administrative leave pending the outcome of the investigations.
