Heather Elvis case hearing canceled, gag order still in effect

A hearing in Charleston that was set for Wednesday morning concerning information in the murder and kidnapping case against a married Horry County couple, has been canceled.

Solicitor Jimmy Richardson said earlier that Circuit Court Judge R. Markley Dennis was to preside over the hearing in which defendants Sidney and Tammy Moorer were expected to appear at 9 am.

Richardson said Tuesday afternoon that the gag order was still in effect, but provided no other details.

However, Attorney Greg McCollum, Tammy Moorer’s lawyer, said Tuesday afternoon that all parties involved were on a conference call on Tuesday instead.

“An Order should be forthcoming from Judge Dennis. It is my understanding that Judge Dennis feels he does not have jurisdiction to change the Gag Order. Due to his ruling, there will be no hearing tomorrow at the Charleston County Court House,” McCollum said.

McCollum added that he does not intend to appeal the decision because the trial start date (May 11) is so close.

The hearing would have been more than a month after Defense Attorney Greg McCollum filed a motion to lift the gag order in late January. Judge Steven John signed off on the gag order in March, limiting the information those involved with the case can publicly release.

Circuit Court Judge Dennis set bond at $100,000 each on January 30 for Sidney and Tammy Moorer, after state prosecutors admitted they have no direct evidence against the couple.

The pair is charged with kidnapping and the death of Elvis, who disappeared in mid-December 2013 and has still not been found.
