A judge denied a motion for summary judgment in a lawsuit related to sexual assault allegations against deceased former Horry County Police Detective Allen Large.
On Wednesday the judge denied the motion for a summary judgment filed by defendants former Horry County Police Chief Saundra Rhodes, and former department officials Dale Buchanan, Thomas Delpercio, Scott Rutherford, and William Squires.
Court documents filed last year alleged that had former leaders at the Horry County Police Department addressed the “predatory behavior” of Allen Large, many of his victims may not have been abused.
The judge ruled that there can only be a summary judgment if “there is no genuine dispute as to any material fact”, which is so in this case.
The lawsuit also discusses the argument that the defendants, who are county employees, can’t be held liable and that they qualify for the same immunity that government entities have. The court rejected this saying that the defendants can be sued even though they work for county government.
