Owner of Inlet Square Mall files lawsuit, claims rent hasn’t been paid in 2 months

The owner of the Inlet Square Mall has filed a lawsuit against the companies that operate the mall, claiming rent has not been paid in two months. 

According to the lawsuit, West C Street Holdings filed the suit against Murrells Retail Associates, LLC and Rait Partnership, LP, which owns Murrells Retail Associates, on Tuesday. 

The lawsuit also states that the ground lease for the mall is dated January 21, 1988 and ends on July 14, 2047. Base rent for the mall is about $547,363 per year with monthly payments of about $45,613. 

West C Street Holdings claims in the lawsuit that Murrells Retail Associates and Rait Partnership failed to pay rent for June and July 2018, and are “currently two months behind on rent.”

Murrells Retail Associates and Rait Partnership were sent a notice of default and have not responded, West C Street Holdings also claims. 

West C Street Holdings requests in the lawsuit that Murrells Retail Associates and Rait Partnership be “enjoined from collecting rents and using the rents for its own purposes” and be required to “place the rent of any tenant that it collects from either into the court or in the hands of the receiver appointed by the court.”
