MYRTLE BEACH, SC (WBTW)- A resort on ocean boulevard says the restaurant next door continues to violate myrtle beach’s noise ordinance and is asking a judge to stop it.
The Holiday Inn Pavilion filed an injunction against Rip Tydz saying the noise is hurting their business and guest have lodged numerous noise complaints, and are preventing pavilion owners and visitors from enjoying the resort.
The Holiday Inn Pavilion opened in 1996 as a hotel and in 2006 started selling some units as privately owned condos. RipTydz opened in august of 2017 right next door. According to court filings, RypTydz was built with no side walls to mute sounds and only 13 inches away from the Holiday Inn Pavilion. Court documents said the Pavilion has received complaints from guest and online reviews. Something Oliver Demeree saw before he booked his stay.
“When I researched it a lot of the reviews I read online mentioned it being noisy and recommended getting a room on the ocean side because it would be quieter,” said Demeree.
According to the filing, Holiday Inn Pavilion states it repeatedly asked RipTydz to turn music down and that the restaurant recently added live music concerts to it’s ocean front grounds.
“When I’m out here I can hear a lot of noise but in my room it’s fine,” said Demeree.
Court documents said Myrtle Beach Police responded to RipTydz numerous times for noise complaints. RipTydz owner Steve Ghidella did not want to speak on camera but gave a statement saying:
“The police have been called numerous times but we have never been issued a noise violation. Police have never told us to lower music and that the music has not come close to 85 decibel level for its sound. “
Ghidella said he’s always tried to be a good neighbor and none of the other neighboring businesses have complained.
“We went to the restaurant one night and it’s a nice place but its definitely loud. Again, which is why we didn’t get a room on that side of the building,” said Demeree.
We reached out to Holiday Inn Pavilion and they declined to comment. Court documents said RipTydz must respond to the complaint in 30 days.
