CONWAY, SC (WBTW)- Tuesday was day one of the trial for Tammy Moorer who is who is charged with conspiracy to kidnap and kidnapping in the 2013 disappearance of Heather Elvis.

Elvis’ body was never found, but police believe she’s dead.

The prosecution and defense had their opening statements, and Monday packed with testimony as 8 witnesses took the stand.

The prosecution argues Heather Elvis was having an affair with Tammy Moorer’s husband, Sidney, that Elvis thought she might be pregnant, and that Tammy and Sidney conspired and kidnapped her.

The defense argues there is no evidence Tammy and Heather ever came face to face and that phone records show Tammy was at home during the time of Elvis’ disappearance.

Two of heather’s co-workers at Tilted Kilt, where Sidney also worked, testified Heather took a pregnancy test at the restaurant.

“She took a pregnancy test and brought it out of the bathroom and it said error,” said Jessica Cooke.

They both said Heather was afraid of Tammy Moorer, but the defense pointed out Tammy Moorer was never seen at Tilted Kilt.

Stephen Schiraldi was then called to the stand. He took Heather Elvis on a date just hours before she went missing.

The defense asked if Heather seemed scared, and Schiraldi said no.

There was also testimony regarding phone records between the Moorer’s and Heather Elvis. 

The prosecution went into great detail how many times the Elvis and Moorer’s phones called each other between July and Decemeber of 2013.

The defense argued the Moorer phone didn’t call Heather Elvis at all during the month of December, but Elvis’ phone called the Moorer’s.

The witness testified the last time Heather Elvis used her phone was to call the Moorer’s.

“The last activity was on the 18th of December 2013, at 3:41 a.m.,” said Mr. Witt.

Day two of Tammy Moorer’s trial starts Wednesday morning.
