CONWAY, SC (WBTW) – Charges have been dropped against a former Horry County police officer indicted in 2016 for misconduct in office, according to court records.
The Horry County Public Index states three misconduct in office charges against former officer Luke Green have been dismissed. The online records indicate charges were dropped Tuesday morning at 7:44 a.m.
The 2016 indictments alleged that Green knowingly engaged in an inappropriate sexual relationship with an informant and made inappropriate sexual contact with a suspect during an arrest.
In 2017, the South Carolina Attorney General’s Office reported that Green was offered a plea deal in and Green’s attorney made a counteroffer that would allow Green to enter pretrial intervention to work off his charges and avoid jail time. Green would also surrender his law enforcement credentials and never work in law enforcement again. The Attorney General’s office accepted that plea deal in August 2017.
It’s unclear at this time if Green must adhere to the previously agreed upon circumstances, as the public index does not give reason for the charges being dropped. News13 reached out to the Attorney General’s office and Communications Director Robert Kittle says “this was a prosecutorial decision based on the facts of the case.” He didn’t comment further on the decision.
Brad C. Richardson, Green’s defense attorney, confirms the charges have been dropped. According to Richardson, the charges may be eligible for expungement. He could confirm if they would be expunged or when this could happen. He didn’t comment further.
