BLENHEIM, SC (WBTW) – A former Marlboro County deputy has been charged following an incident at a middle school involving a juvenile.
James Patrick Legette, 30, was charged on Wednesday with assault battery, second degree, and misconduct in office, according to Thom Berry, with the South Carolina Law Enforcement Division.
These charges reportedly come after an incident nearly two weeks ago at the Bleheim Middle School of Discovery. Legette was assigned as the school resource officers, according to the arrest warrant.
Legette unlawfully grabbed “a non-resistant juvenile victim, with force, throwing him against his patrol vehicle, causing the juvenile victim to strike his head and neck area,” the investigating deputy wrote in the warrant. The incident was corroborated by video and witness statements.
Legette is further charged with misconduct in office for allegedly falsifying documentation by reporting the juvenile resisted him, according to the warrant.
SLED tells News13 that Legette is no longer working with the sheriff’s office. SLED investigated the case at the request of the Marlboro County Sheriff’s Office.
Legette was booked at the Malboro County Detention Center.
