CHARLESTON, SC (WCBD) — The man who police say is responsible for the death of his wife in 2012 will not be indicted.
A grand jury declined to indict Robert “Bob” McCaffrey for a murder charge in connection with the disappearance of his wife, Gayle McCaffrey.
Sheriff Al Cannon, after hearing the news, was “disappointed in the outcome.” The Sheriff also stated, “Bob McCaffrey is responsible for the murder of his wife and detectives will continue to work the case in order to bring charges again as more information develops.”
The Obstruction of Justice charge against McCaffrey is still pending.
An arrest affidavit reveals Bob told investigators he was involved in a verbal argument with his wife on March 17, 2012 before driving to Easly, S.C. to visit a family home in an effort to assess his marriage.
Deputies say through the investigation it was discovered that he had driven to the upstate but instead met with a paramour he was having an affair with in Travelers Rest, S.C.
He later returned to Charleston. Investigators say he reported his wife missing 12-hours after returning to the home.
Gayle McCaffrey did not take a cell phone, wallet, keys, or her car. The defendant said she left home in the middle of the night when their two children were sleeping.
The affidavit also reveals the defendant provided investigators with a typed letter which he said Gayle wrote. The letter said she took a safe with her which had $110,000 in cash and a gun.
Investigators say people they spoke with said the safe never existed.
The affidavit also reveals that a linguistics expert determined that it was more probable than not that Gayle McCaffrey did not write the letter.
The letter also made mention that she was running away with her lover “Nicky”. Investigators say there is “ample evidence” that at the time of her disappearance Gayle was making efforts to reconcile her marriage including booking a romantic getaway for the two just two days before her disappearance.
In March of 2018, Gayle McCaffrey was legally classified as deceased.
Charleston County Sheriff deputies say Bob McCaffrey lied to investigators several times, refused to cooperate with search efforts for his wife, and declined to have any parental relationship with his children.
